Cover Designs

By utilizing any artwork and/or designs crafted by Joelle Cottle, you acknowledge and agree to the following terms:

Ownership & Design Integration:
a. Joelle Cottle retains ownership of all original assets and designs produced, within the boundaries of applicable law. The designs might include the use of AI-generated art (with a commercial license), stock assets, digital illustrations, renders, photo editing, and fonts. All materials utilized in the designs maintain the ownership of their respective creators. You are granted usage rights for the completed designs, which are valid indefinitely.
b. It is your responsibility to ensure that the licensing agreements from relevant companies encompass your intended usage of the incorporated materials. If your usage exceeds 500,000 copies for books, extended licensing for stock imagery might be necessary.

User-Provided Artwork:
a. If you provide any artwork for reference or inclusion in the design, you warrant and affirm that you possess suitable licensing, permissions, or rightful ownership of said artwork. You confirm that all necessary consents and permissions from relevant copyright holders have been obtained to authorize the utilization of the provided artwork in our design. You understand that we will not be held liable for any copyright infringements related to user-provided artwork.

Exclusivity:
a. Certain components like stock images, fonts, and AI-generated art might be accessible and employed by others. Therefore, the design and/or assets cannot be exclusively allocated. Each completed design will be made available for purchase only once.

Commercial Usage & Limitations:
a. Joelle Cottle owns the unique amalgamation of elements that constitute the complete design, within the boundaries of applicable law. When you acquire a pre-made design, you gain commercial usage rights for the entire cover design, and delivered artwork. However, the extraction of any fonts from the design for separate use is explicitly prohibited (I will include a list of fonts used).
b. Source design files will not be furnished, and the resale of the design is prohibited. Refunds or remedies related to licensing issues arising from user-provided materials are not within our responsibility.

Usage Restrictions
a. No Shocking or Disturbing Use: The User is expressly prohibited from using the provided images in a shocking or disturbing manner, including but not limited to adult content, pornography, or gore.

Showcasing Rights:
a. Joelle Cottle reserves the right to showcase any completed design in her portfolio, on her website, and for marketing purposes, unless otherwise agreed upon in writing.

Proofing and Liability:
a. You are solely responsible for thoroughly reviewing and proofing the files before proceeding with printing or submitting them for publication. You also acknowledge that you bear any legal implications arising from the use of the artwork. We cannot be held accountable for any losses incurred due to errors discovered after the publishing process.

Limitation of Liability
a. Limitation of Liability: The Provider is not liable for any damages or losses incurred by users in connection with the use of the images, even if advised of the possibility of such damages.

Disclaimer:
All AI-generated visuals are the result of advanced artificial intelligence processes. Any likeness to real individuals, whether currently living or deceased, or to actual events, is purely coincidental.

Refund Policy
a. Refund Policy: Refunds are not offered for digital products.

Accreditation and Acknowledgment:
a. Properly attributing the cover design is greatly appreciated. Kindly attribute the cover design to “Cover design by Joelle Cottle.”

Acceptance of Terms
a. Acceptance: By using any artwork or designs created by Joelle Cottle, the User acknowledges having read, understood, and agreed to these Terms of Use in their entirety.

Ownership & Usage Rights
a. Ownership: Joelle Cottle, hereinafter referred to as the “Provider,” retains full ownership of all original assets and designs utilized in the provided artwork, subject to the applicable legal framework. These assets may encompass AI-generated art, duly licensed for commercial use. The User is hereby granted non-exclusive usage rights for the provided artwork, with no set expiration date.

Exclusivity
a. Non-Exclusivity: The provided image is non-exclusive, meaning it may be accessible and utilized by multiple parties.

Commercial Usage & Restrictions
a. Ownership: All images remain the exclusive property of the Provider, Joelle Cottle. The User is granted commercial usage rights for the images, solely for lawful purposes.
b. Resale Prohibition: The User is expressly prohibited from reselling the provided images.

User-Provided Artwork
a. Warranty and Ownership: If the User provides any artwork for reference or inclusion in the design, they hereby warrant and affirm that they possess suitable licensing, permissions, or rightful ownership of the provided artwork. The User further confirms that all necessary consents and permissions from relevant copyright holders have been duly obtained to authorize the use of the provided artwork in the design provided by the Provider. It is imperative for the User to understand that the Provider shall not be held liable for any copyright infringements or legal issues arising from the use of user-provided artwork.

Modification of Images
a. Image Alterations: Users may modify the provided images to suit their specific needs, but they are still bound by these Terms of Use regarding the usage and resale of modified images.

Image License Duration
a. License Duration: The granted usage rights for the provided artwork are valid indefinitely unless otherwise stated.

Termination Clause
a. Termination of Usage: The Provider reserves the right to terminate a user’s license under circumstances such as misuse, violation of copyright, or breach of the Terms of Use.

Showcasing Rights
a. Provider’s Right: The Provider, Joelle Cottle, reserves the unequivocal right to showcase any completed design containing the provided artwork in her portfolio, on her website, and for marketing purposes, unless an alternative arrangement is agreed upon in a mutually binding written agreement.

Proofing and Liability
a. User Responsibility: The User assumes sole responsibility for meticulously reviewing and proofing all files incorporating the provided artwork before commencing printing or submitting them for publication. Furthermore, the User acknowledges and accepts all legal consequences arising from the use of the artwork. The Provider cannot be held liable for any financial or legal losses incurred due to errors detected subsequent to the publication process.

Refund Policy
a. Refund Policy: Refunds are not offered for digital products unless there is a problem with the file download.

Disclaimer
a. AI-generated Visuals: All AI-generated visuals are produced through advanced artificial intelligence processes. Any resemblance to actual individuals, whether living or deceased, or to real-world events, is purely coincidental.

Governing Law
a. Applicable Law: These Terms of Use shall be governed by and construed in accordance with the laws of Canada, with any disputes subject to the exclusive jurisdiction of the Canadian courts.

a. Acceptance: By using any artwork or designs created by Joelle Cottle, the User acknowledges having read, understood, and agreed to these Terms of Use in their entirety.
