Copyright surrounding AI-generated imagery can be complex, and I am a designer, not a legal professional. The information below reflects my understanding and is not legal advice.
I use AI-generated imagery as one of the tools available to me when creating book covers. The services I use provide commercial-use rights for the images I generate, allowing me to incorporate them into commercial book cover designs.
AI-generated imagery is similar to other third-party visual assets used in book cover design, such as stock photography. The copyright and ownership of an individual image can depend on how it was created, how it is used, and the laws that apply. My role as the designer is to create the finished cover through composition, typography, image selection, editing, retouching, and other creative decisions.
I choose AI-generated imagery when it allows me to create a visual that better suits a book’s specific concept, characters, setting, or atmosphere than the available stock photography. I do not use living artists’ names in prompts or intentionally attempt to reproduce a specific living artist’s style.
I also want to be transparent that I cannot guarantee the copyright status of any individual AI-generated image or provide legal advice regarding copyright. If you have specific legal concerns about the use of AI-generated imagery for your book, I recommend consulting a qualified legal professional.
